Terms of Service (TOS)
Terms of Service (TOS)
These Terms of Service govern the use of selected areas of the website as well as grants, contributions, memberships and related association services of RishiFamily.
For additional information on the processing of personal data, please see our Privacy Policy. Information about the provider can be found in our Impressum. Information on technically necessary cookies can be found in our Cookie Policy.
1. Scope of Application
These Terms of Service apply to all grants, contributions, memberships and other association-related services offered, managed or facilitated through the RishiFamily website.
Where additional notices, conditions or special provisions are indicated directly on the website for individual services, these take precedence for the respective case.
2. Provider and Nature of the Offer
The provider of the funding opportunities and services offered through this website is the RishiFamily association designated in the Impressum.
3. Registration and Membership
Certain areas, content or funding opportunities require registration or membership. Registration as a member is generally free of charge, unless otherwise stated in the respective offer.
There is no entitlement to admission as a member, to the provision of specific content, functions or technical features, or to their unchanged continuation, unless RishiFamily has expressly promised or accepted a specific service in individual cases.
Members are obliged to provide accurate information and to update any relevant changes promptly in the member area.
4. Grants and Contributions
Through the website, one-time or recurring grants may be made in support of the association's work, individual projects, events, content or memberships.
The contribution amount, total amount and any information on duration, interval, content or consideration displayed on the website are binding for the respective grant transaction.
The presentation of funding opportunities on the website does not constitute a binding offer by the association, but an invitation to make a grant.
5. Formation of the Grant Relationship
By submitting a grant transaction, you make a binding offer to enter into the respective grant relationship.
The grant relationship is formed when RishiFamily accepts your grant. Acceptance may occur in particular through a confirmation on the website, a confirmation email, the provision of a grant confirmation, the activation of access or the performance of the service associated with the grant.
6. Payment Processing
The payment methods displayed in the respective grant transaction are available for grants.
Where activated on the website, payment processing may be carried out in whole or in part through external payment service providers, in particular Stripe. In such cases, the information, amounts, intervals and payment methods displayed in the respective payment step are binding.
The association is not obliged to permanently provide a specific payment method. Payment methods may be adjusted, extended or removed before launch, during the development phase or in ongoing operations.
7. Grant Confirmation
For successfully accepted grants, you will receive a grant confirmation or a comparable association-related confirmation.
A grant confirmation is not an invoice to members or contributors, unless expressly stated otherwise in individual cases.
For traceability, the grant confirmation may be based on the historical data stored at the time of the grant.
8. Recurring and Monthly Memberships
Where recurring or monthly memberships are offered on the website, they are deemed to be recurring grants with the interval described in the respective offer.
Such memberships are automatically renewed for the next payment period unless they are terminated before the end of the current paid period and unless otherwise stated in the specific offer.
The specific details on amount, interval, start, renewal and termination are set out in the respective grant transaction and the associated information on the website.
9. Withdrawal and Special Notices for Consumers
Grants to RishiFamily are generally made as voluntary support for the association's work and individual projects. Where a grant is made without separate consideration, there is no statutory right of withdrawal.
Where a grant is linked to membership, access to digital content, participation in an event or another separately assessable service in individual cases, the statutory provisions and the conditions described in the respective offer apply.
A right of withdrawal for grants is excluded where no mandatory statutory right of withdrawal exists.
10. Termination of Membership
Members may terminate their membership. Where recurring or monthly memberships exist, termination generally takes effect at the end of the current paid period, unless otherwise provided in the specific offer or by mandatory legal provisions.
After termination of membership, active personal member data will be anonymised without delay, unless statutory retention, evidence or processing obligations require otherwise.
Details on data processing, anonymisation and retention periods are set out in the Privacy Policy.
11. Use of the Website and Member Area
Members and users undertake to use the website, their own account and the member area only within the intended functions and in a lawful manner.
Access credentials, confirmation codes and comparable security features must be treated confidentially and protected from unauthorised access by third parties.
In particular, abusive or automated access, circumvention of security mechanisms, use of third-party accounts without authorisation and unlawful or disruptive interference with the operation of the platform are prohibited.
12. Restriction, Blocking and Further Development
RishiFamily is entitled to change, restrict, block or discontinue functions, areas, content or access to the website and platform in whole or in part at any time.
The platform is under continuous development. Functions may therefore be extended, changed, merged or discontinued.
13. Changes to these Terms of Service
RishiFamily may amend these Terms of Service at any time. The version published on the website applies to future grant transactions and future use.
For completed and fully processed grant transactions, the version applicable at the time of the respective conclusion generally applies, unless mandatory legal provisions require otherwise.
14. Final Provisions
Austrian law applies.
Place of jurisdiction is, insofar as legally permissible, the registered office of the association.
Should individual provisions of these Terms of Service be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
